Good news from the civil forfeiture front

Forbes: Under Maryland’s draconian “civil forfeiture” laws, people do not have to be convicted, or even charged with a crime, to permanently lose their cash, cars or other valuables. Once their property has been seized, spouses, parents and other innocent owners actually have to go to court and prove that they are innocent of any wrongdoing.

Thankfully, Maryland lawmakers are working to rectify this injustice. Last month, the Maryland General Assembly not only voted to override a veto by Gov. Larry Hogan from last year, but also saw new legislation unveiled that further protects due process rights.

First, SB 528, the subject of the veto override, applies the presumption of innocence to civil forfeiture cases. It requires that the state prove that property owners violated the law or knowingly let their property be used in crimes. Prior to the law, Maryland, along with 34 other states and the federal government, typically placed the burden of proof onto the owner, rather than the government, in civil forfeiture cases.

The new law also prevents law enforcement from forfeiting cash under $300, unless they can prove it is related to the drug trade. For those living paycheck to paycheck, and who have broken no law, an unjust seizure by the government can prove devastating. (read the whole thing)

When I was young, police did not make that much money compared to what they make now. Government on a whole is expensive, and increasingly taxes can't cover the expenses. They need to raise money they best way they can, and that means taking other peoples money. Be very careful when you are driving.

The Queen of civil forfeiture is our current AG, Loretta Lynch. That was one of the reasons Obama tapped her. Obama loves civil forfeiture. It is a law abused by Dem and Rep pols.

Civil forfeiture is a disgusting use of government power that is as far from the American idea as you can get. Gov. Hogan is a Republican, and that doesn't mean dick if you are his kind of Republican. I bet he calls himself a conservative too, but he's a living King George loyalist.

Funny thing about that Supreme Court. They can find Abortion and Gay Marriage in the constitution but they can't find the Fourth Amendment.

Love how the nimble, responsive, transparent, accountable, and totally representative government of OUR Republic is so quick out of the gate with laws that might tamp down on that all-important revenue generation.

I think civil asset forfeiture needs to be abolished wholesale. It's an utterly unconstitutional mechanism to steal peoples things. If I was president I'd abolish it via Executive Action on day one.
