Masterpiece Cakeshop wins again.

Colorado dropped its second prosecution of Jack Phillips for refusal to bake a 'gender-transition cake."

This is a post by William Jacobson at Legal Insurrection.

As you know Jack Phillips was targeted by out of state gay activists to be made an example. The visiting couple, Charlie Craig and David Mullins were made parade grand marshals of Denver Pridefest following Colorado's defeat in the Supreme Court.

La la la, we lost but we're partying anyway. And we've only just begun our harassment of Christianity.

On the same day the Supreme Court decided to take the case, Attorney Autumn Scardina called the cake shop to request a "gender transition" cake. The cake shop declined.

Colorado waited for the Supreme Court ruling to issue a finding of probable cause.

Jack Philips fights back. The introduction to his complaint argues the cake shop was targeted. His complaint focuses on the message that was demanded. They targeted him knowing he'd object to writing on the cake something outrageous to him personally.

From his point of view it was like an attorney grabbing him by the neck and demanding, "write what I tell you to write, Bitch." And having the State side with the aggressor. Phillips kindly declined while offering to create a different custom cake or any other pre-made cake. He did not refuse them service, rather, he refused to write what they demanded. Similar to commissioning an artist and demanding they paint some specific pornographic picture, knowing a practicing Christian will object and resist.

A preliminary injunction was scheduled for March and somehow that may have put pressure on the State because Colorado dropped the administrative case against Masterpiece and then Masterpiece agreed to drop the federal lawsuit.

So round two is over and the Masterpiece Cakeshop prevailed.

Much more details at Legal Insurrection.

I've read some very stupid and aggressively arrogant and wrong comments to this at Instapundit, while the comments at Legal Insurrection are a lot more well considered.

[I emailed Jack Phillips a long time ago and he responded graciously. He's a very nice man.]

Mmmm, cake.

I bet Jack Phillips can make cakes a lot better than I can. After all, he does it everyday.

I used box mixes and prepared frosting and tinned Mandarin oranges. And I'm shit at writing on a cake. Come on, Hommes, make your own cakes.

It's ugly but this cake was delicious.

The Left and their political arm, the Dems, are adept at tearing things down but not so good at building anything.

Leaving aside the issue of homosexuality, wouldn't property rights be destroyed if a customer could FORCE a business to conform to his specifications in the product he orders?

If the left could - they'd chop him down and kill him.
The left ARE the taliban.
