Former prosecutor: "She's going to have to be charged with a crime."

Former federal prosecutor Joseph DiGenova stirred the Hillary Clinton hornets' nest Tuesday when he said on talk radio that he is convinced "she's not going to be able to complete her campaign" because "she's going to have to be charged with a crime."
"Her biggest problem right now is the FBI. They're not going away," DiGenova said on the "Laura Ingraham Show." "They have reached a critical mass in their investigation of the secretary and all of her senior staff. And it's going to come to a head, I would suggest, in the next 60 days. And I predict Hillary will not make it to the finish line."
DiGenova said that investigators have found more than 1,200 classified emails from the private Clinton account, and he indicated that they are likely to recover more from her hard drive. The evidence that the FBI is finding against her is so compelling that Attorney General Loretta Lynch will have no choice but to charge Clinton, he believes. If Lynch resists, "there will be a massive revolt inside the FBI, which she will not be able to survive as an attorney general. It will be like Watergate." 
So overwhelming is the evidence, explains DiGenova, that if there's no indictment, the FBI "will never be able to charge another federal employee with the negligent handling of classified information. The intelligence community will not stand for that. They will fight for indictment."

If the media dropped her, she would collapse. Will Obama and his hack Lynch let the FBI prosecute? They won't, but they risk that lawlessness rubbing off on them. Not that they care.

I wouldn't count on this. If I've learned anything in the last 7 years, it's that there is no law, no principle, no precedent, and no truth that the Democrats won't step on, and that Democrat voters won't ignore in the voting booth. Hillary will get tens of millions of votes no matter what happens. She won't face criminal charges, and I think she could win 85% of the Democratic vote from Federal prison anyway.

The Current FBI director James Comey when he was the number 2 at the Justice Dep. wrote a resignation letter over something he characterized as "an apocalyptic situation".

I would not take this job if I thought I was going to be working with people who didn't share my love of the law and love of the institution. So I don't think I'll ever find myself in that position. I can commit to you though, that -- because I talk so much about integrity and about this great group behind me -- that's what I really care about. I don't care about politics. I don't care about expediency. I don't care about friendship. I care about doing the right thing. And I would never be part of something that I believe to be fundamentally wrong. I mean obviously we all make policy judgements where people disagree, but I will do the right thing.

Over the last two weeks I have encountered just such an apocalyptic situation, where I and the Department of Justice have been asked to be a part of something that is fundamentally wrong. As we have struggled over these last days to do the right thing, I have never been prouder of the Department of Justice or of the Attorney General. Sadly, although I believe this has been on of the institution's finest hours, we have been unable to right that wrong.

I would give much not to be in this position. But, as I told you during our private meeting last week, here I stand; I can do no other. Therefore, with a heavy heart and undiminished love of my country and my Department, I resign as Deputy Attorney General of the United States, effective immediately.

I guess Comey could always say giving Hillary a pass is not "an apocalyptic situation"... does not rise to the level of indictment... because there was no controlling legal authority... and after all, at this point (looking at you Chip) what difference does it make?

Of course no one can know, but I’ll predict that Mrs. Clinton will self destruct. I mean she will give her enemies the sword and she will show them where to stick it in.

If the FBI can’t be called off, then a special prosecutor will have to be appointed. That special prosecutor will be called partisan and going on a fishing expedition, but will eventually get to interview Mrs. Clinton and her story will be different than what she has already told the investigators.


Lem- what was the circumstance that led Comey to write that?

The resignation threat was about warrantless collection of metadata. In the end, Comey backed down and did not resign and the metadata collection program continued with minor changes. I suspect he will back down again.

What folks don't understand is the STRONG allegiance people in the intelligence community have to the sacred duty of keeping secrets. Anyone who knows me knows my contempt for the govt. and most people in the govt. But, intelligence people are some of the best folks in govt. If some charges are not brought, you will see "unnamed sources" coming forward w/ so much shit on her even loyalists will be shocked. Just my opinion, I could be wrong.

Yup, there will be no Prog March. SOP. Get us all excited about the prospect of Justice then drop us like a rock. Lynch will refuse to prosecute in exchange for undisclosed favors (and the exchange will go undisclosed as well), the MSM won't pause to note the grotesque double standard much less the crimes of the Clinton Cartel as they will be busy focused on Rubio's shoes or whatever, and all the little progs in progville will pat themselves on the back for being "clever" and weaseling out of an admittedly bad situation due to heavy-handed and hypocritical control of the narrative, the government, and the media. Yay.

Here is how MY twisted mind works. Hillary gets the nomination, Bill is running as VP. Hillary gets indicted and goes to jail or resigns.....BILL is President again!

Everyone is happy, especially Bill since...ding dong the witch is dead!!! and he can play in the White House with interns again.

This can work because the 22nd amendment only deals with how many terms a person can be "elected" President and doesn't cover VP to President or other succession due to a vacancy further up the ladder.

1. Barack promises Hillary no indictment if she selects him as VP candidate. She agrees.
2. Barack brings out the black and progressive voters and Hillary is elected President.
3. After the electoral college vote but before the swearing in, Hillary is indicted and imprisoned without bail pending her trial and abdicates her future presidency in exchange for the promise of a pardon from Barack.
4. Barack is sworn in as POTUS.
5. Hillary is tried and convicted and sentenced to 20 years because that's just how Barack rolls.

Here is how I hope things go:

1-Hillary's campaign and poll numbers tank due to the voters finally taking Bill's sexual assaults seriously and blaming both Hillary and Bill for their actions.

2-As a result, Hillary goes berserk and kills Bill and then she is imprisoned to an insane asylum. [Call this a true twofer for conservatives!]

3- Repub candidate wins the 2016 election and sweep the House & Senate races so Repubs no longer have any reason to not implement many many many conservative reforms to the fed govt.

4- The winning candidate sends flowers to Hillary and sends flowers to Bill's grave.

Rabel, that sounds like a book waiting to be written. However, Obama would be wholly unqualified at this point to be eligible to become president again. His two terms are up and there is no precedent that I know of that would allow him to be in line for succession to serve a third.

If Hillary is indicted during this campaign, I'll be genuinely shocked. There is no fucking way on this planet that I'm on right now that this POS of a human being will ever see a 6' x 9' room with bars. She feels and thinks she is utterly immune to any indictment or prosecution. If she isn't indicted then it will be a clear indication that she is being protected until after the election. If she wins, it goes away, if she loses, then her protection is gone. She'll get indicted, she'll most likely won't see a trial and plea deal 5 years probation, get it knocked down to a misdemeanor. If she does go to trial she will most likely be acquitted for being a sheer idiot. I don't see her going to prison at all.

Obama is ineligible to be "elected" president per the wording of the 22nd amendment.
Nothing in the constitution prevents him from being elected vice-president.
Nothing in the constitution prevents him from serving again as president.

It would take a court ruling based on the intent rather than the text of the 22nd to absolutely prevent the VP and ascension route to the presidency for a two-termer. How the drafters of the 22nd screwed that up, I don't know, but they did screw it up if they intended to prevent a third term under all circumstances.

At least they didn't ship any high tech missles to Cuba.

Ok, how about this scenario:

1. Hillary wins the POTUS
2. Hillary dies in the first month from some condition that had been hushed up
3. Bill Clinton tries to take over as POTUS
4. VP [insert name] says: "BULLSHIT!" and whacks Bill, and goes to prison
5. America lives happily ever after
