Simply because one is told something does not mean said thing is true. The idea of a list seems to have stemmed from a list of all the names to come out of the grand jury proceedings ordered by the presiding judge.
It would seem a more logical place to look would be the flight logs, which are public, but being listed on them does not constitute proof of wrongdoing. The one thing I've read which makes more sense than anything else is analysis of all the videotapes, which are described as pretty ghastly.
Of course, some people won't be satisfied with anything.
