"Judge halts Obama's immigration action"

DHS (Homeland Security) does have discretion in the manner in which it chooses to fulfill the expressed will of Congress. It cannot, however, enact a program in which it not only ignores the dictates of Congress, but actively acts to thwart them,” Hanen wrote. “DHS Secretary [Jeh Johnson] is not just rewriting the laws he is creating them from scratch.”
White House Press Secretary Josh Earnest said Hanen’s decision was at odds with Supreme Court precedents and laws giving immigration officials broad discretion in deciding whom to deport.

“The Supreme Court and Congress have made clear that the federal government can set priorities in enforcing our immigration laws — which is exactly what the president did when he announced commonsense policies to help fix our broken immigration system,” Earnest said. “Those policies are consistent with the laws passed by Congress and decisions of the Supreme Court, as well as five decades of precedent by presidents of both parties who have used their authority to set priorities in enforcing our immigration laws.”

I'm going to assume there are better arguments on the administration's side than the one quoted from the press secretary, which would get you a gentleman's "C" if you wrote it in a blue book and then handed it off to the proctor for the Administrative Law final.

Full disclosure: I never had the slightest idea what was going on with Chadha and what came afterwards. I think I ended up with "C" for the course.

Via Obamacare, the Control of the Internet, use of the IRS as political enforcer, control of the election process by the FEC, thugs on the ground and uncontrolled immigration and the neutering of the leadership of the armed services, Obama already has almost total de facto functional control of American society. Most Elephants are feckless and the courts are packed with leftists.

Just remember, April, it's always darkest before it goes totally black..

Reid suspended the filibuster. What's good for the goose...Get that DHS Funding Bill to Obama's desk, force him to veto it and then when the Dems and the MSM start crowing about how the Republicans shut down the gubmint crow back that Obama did it Obama did it Obama did it. You're the majority leader now, start acting like it.

I'm pretty awful at commenting. I admit it readily and cheerfully.

For example, I completely whiffed the opportunity to incorporate into my 8:36 an oblique reference to the song Ja-Da, which rhymes with Chadha (get it?), which I learned about from a lecture series I listened to on Jazz appreciation.

Sorry about that.

Freaking fantastic.

Today he was talking about how birds migrate, how they predictably take advantage of prevailing updrafts, and tailwinds, and geographic markers, and how they navigate using the star patterns and magnetic fields and stuff.

Pretty freaking amazing.

Strange brain lock by Rush on this topic today. He started the show talking about the amnesty injunction and after a few minutes he got the issue confused with the Obamacare subsidy case which is going to the Supreme Court.

He acknowledged his confusion after a commercial break, but it was weird.

Early onset. I've seen it happen. I heard it too, but I think his decline was just highlighted. I hope I'm wrong.
