"The big worry is America is asleep and does nothing, while China comes along, lands people on the Moon, and decides, 'We might as well start surveying and laying claim, because who is going to stop us?'"
Does the possibility of China beating America back to the Moon worry him? "A lot. ... Tell me something that they don't have significant interest in," he replied. "Name something."

Bigelow is applying to the Federal Aviation Administration's Office of Commercial Space Transportation to amend a 1967 international agreement on the moon so that a system of private property rights can be established there. "When there isn't law and order," he said, "there's chaos."

The space treaty is the dumbest piece of ill thought out commie worship ever... and it happened when we still thought commies were evil. Actually, it's probably entirely due to Cold War paranoia and wanting an excuse to hold the other guy back that it was passed at all.
Short sighted, since no one really thinks it will hold China back.
Changing it is a good idea, but I'm pretty sure that all that will really happen in the end is that people who want to own the Moon (or Mars or Ceres or Vesta) and get any sort of return on investment will simply pretend that the treaty doesn't exist and dare anyone to do something about it.

I'd be fine if China would agree to vacate China, along with the US progressive movement: Hillary, Bill, Krugman, Obama, Pelosi, Reid, Media Matters and the cast at MSDNC- and form a colony up there. In exchange we get China. Sure it's a toxic waste dump - but we can clean it up.
