Currently, Irish law states that rape occurs if a person has not consented to intercourse and/or if the perpetrator was reckless as to whether the victim did or did not consent.
However, the courts have had to create their own definitions of consent.

I'm okay with this. So far as I'm concerned, when it comes to matters of alcohol, the people who gave us Guinness Extra Stout can do no wrong.

Yeah, but April, if you go after a drunk sleeping dude, then he isn't really going to stand at attention if you know what I'm saying.

I'd call sex with a drunk person being "reckless" to if they consented or not. It's a weird way to write a law and specificity might be better but...
