The U.S. government's no-fly list banning people accused of links to terrorism from commercial flights violates their constitutional rights because it gives them no meaningful way to contest that decision, a federal judge ruled on Tuesday."
U.S. District Judge Anna Brown... ordered the government to come up with new procedures that allow people on the no-fly list to challenge that designation.
"The court concludes international travel is not a mere convenience or luxury in this modern world. Indeed, for many international travel is a necessary aspect of liberties sacred to members of a free society," Brown wrote.
The no-fly list, established in 2003 in the aftermath of the Sept. 11, 2001, attacks, bars those on it from flying within the United States or to and from the country...

Is international travel a positive right, or a negative right?
Maybe like health care, we need to socialize the airlines.
That way we can get all those fleeing young mexicans onto KLM - Royal Dutch Airlines, and dump them in Rome.

There are many horror stories of legit people getting on these lists. A remedy is quite reasonable.
I seem to remember something about provide for the common defense.
Nothing about international travel.
But, hey, it's a living document, right?

There are no perfect remedies to anything. Lift the ban and some terrorists might slip through.
oh well.
Sadly, the same types of people who run the IRS run other governmental agencies. We are not in good hands. No one is hard at work making sure John Q Public is mistakenly on the wrong list, and that terrorist is on the right list.
Donald Sterling had a policy of no-fly girls at Clippers games and it got him thrown out of the NBA.
So this is not unreasonable.

The linked article had a quote from the director of ACLU's National Security Project, a woman named Hina Shamsi. The name intrigued me and so I went searching for her national origin. Couldn't find it, but I did find her in an interview with Al Jazeera about the U.S. drone policy, and she doesn't appear to be an American by birth.
While looking for that, I found something else very interesting -- this April the NYPD closed down its unit that created maps and collected other information on Muslim communities in the New York City area. Needless to say, Hina had worked to end the unit's work and was thrilled:
“The Demographics Unit was only one component of a huge, discriminatory surveillance program that has sent informants and NYPD officers to spy on mosques, charities, student groups, and other mainstays of New York Muslim life. We look forward to an end to all aspects of the bias-based policing that has stigmatized New York's Muslim communities and done them such great harm.”
And now the no-fly list. Way to go, ACLU.
