Hillary's fate depends on the Democrats

There is much discussion about whether Trump's Justice Department should investigate and prosecute Hillary on the email scandal.  But there is no such discussion about whether Obama should pardon Hillary.  At this point, Trump said he does not want to "hurt" Hillary, but I believe that this may change depending on how Democrats respond to Trump's agenda and confirmation of his nominees.

The FBI  investigated Hillary on the email scandal and is investigating the William Jefferson Clinton Foundation, aka the William J. Corleone Foundation, which involves Hillary, Bill, and Chelsea.  As we all know, the FBI concluded that Hillary did not violate the applicable laws because she did not have criminal intent.
We have to wait for the conclusion of the FBI investigation of the Foundation to see the Bureau's recommendation.  This will probably take months.  If the FBI recommends criminal charges arising out of the operation of the Foundation, then the Trump Justice Department will most likely indict.  To prosecute Hillary on the email scandal, though, will require the Justice Department to do a thorough investigation with a grand jury to subpoena witnesses and documents.  The question is, should Trump order such an investigation now by appointing a special prosecutor?

The most important immediate issues facing Trump are to repeal Obamacare, reduce tax rates, and deal with immigration by cutting off aid to sanctuary cities, building the wall, deporting illegals with criminal records, reviewing those who violate their visas by overstaying, and closely vetting immigrants from Muslim countries.  Along with these issues, Trump must get his appointees confirmed.  There is already opposition to Jeff Sessions, and there will be opposition to the Supreme Court nominee.

Given this, it is crucial that Trump's appointees get confirmed and that the immediate agenda issues be implemented.  Appointing a special prosecutor for the email scandal at this time is a distraction from these crucial issues.  Trump is trying to unify the country to get his agenda moving.  He said he is not investigating Hillary for the email scandal.  This is part of his attempt to unify the country and win some Democratic support for his agenda and for his appointees.  Also, by saying he does not want to "hurt" Hillary, Trump is removing any reason for Obama to pardon Hillary, which leaves Hillary's fate to Trump.

The ball is now in the Democrats' court.  Will they accept the good-faith move by Trump and reciprocate by confirming his appointees and not obstructing his agenda?  

If the Democrats go to war on the appointees, as they did with Judge Bork, and obstruct every part of the Trump agenda, then the reason for not appointing a special prosecutor to investigate Hillary's email scandal is no longer applicable.

I believe that Trump is using Hillary to deal.  It is up to the Democrats to decide whether to abandon and sacrifice Hillary so they can obstruct Trump's appointees and agenda.

(I think this analysis hits the nail on the head. Trump is clearing the decks for what he wants to do. He is avoiding unnecessary conflict over Hillary right out of the gate. He can always go back to it. Or he can let the rule of law take over. The US Attorney of the Southern District is all over this. He will make a case if he can. He is very ambitious and this case could make him a candidate for Governor of New York. Especially as he is going after Cuomo. Remember the Bernie Bros hate Hillary just as much as we do.)

I am surprised Trump is not staying silent on this to get Obama to issue the pardon. Unless it is as Troop speculates, he is head faking to avoid the pardon.

But the pardon is a win for Trump. The issue of going after her is off the table for something Obama did. So he wins, and can focus on delivering on issues that actually matter more (like SCOTUS pick). There is a rule in politics: We don't jail yours and you don't jail us. If you get caught you just go away (like Pentangeli--but without the straight razor).

By saying he is not after Hillary he kills the issue for moment. You can always revisit it. Plus if the FBI or the US Attorney for Southern District builds a case he can say "Hey wadda ya gonna do? It's out of my hands."

Simple.

He has a lot of other stuff to do without jumping into that quicksand.

It's all polly ticks innit.

I cannot care about sending a dying old lady to prison no matter how malevolent, nor can I care about building a wall. I do care about these things being discussed, about splitting open tacit aims of activists claiming racist, sexist, homophobic xenophobic, in that chant, I care about seeing their heads explode at just being challenged. I care about smackdowns and the real joy to be had observing freak-fails and the fall of presumptuous self-entitled. Seeing John Kerry denied the presidency was my greatest polly tickle joy until seeing it Denied Hillary Rodham Clinton. *spits*

That dude before showing the clear ice looked sharp in his black shirt. I don't like black for shirts. Too gansta. Real gansta, the Italian kind. That and a white tie. Come on.

And the ladies said that in comments over there. That the guy looks sharp.

But the dudes in comments said he looks like a hipster douche.

See? A difference of opinion there between the two main sexes.

So I bought two black shirts of different qualities. I avoided white buttons. One is a western pattern with snap black buttons. Complaints on Amazon are the material being too thin.

The other is Nordstrom's. They're having a sale. $70.00 shirts and $60.00 shirts on sale for $40.00. So I bought two there. (total 3 shirts)

So I wore the western one downstairs to get the mail and chat it up and three people complimented the shirt.

So, whatever your opinion is, you should buy one.

To see how ladies react. Rack it up to very inexpensive education cost. A test. Because once you're in the shirt you don't care about it anymore, it's other people who see it.

But do not buy a white tie for it, that's gansta.

[My all time favorite design on a tie was a thin black tie with dust colored fingerprint near the bottom. You could draw that yourself on a black tie, or transfer it.]

Sixty is very excitable.

He was in a Cracker Barrel once and the radio started playing "New York, New York" and he demanded that they shut it off.

When they didn't he shot out the speaker.

I think that's a very good analysis.

A full investigation, like a challenge of the election, could overturn a lot of very uncomfortable applecarts for the Demos.

A wise commenter here wrote that one's reactions to politicians goes back to youthful hurt. My reaction to Trump's apparent unwillingness to prosecute Mrs. Clinton, and I say apparent because he's not even in office yet, when contrasted with his direct statement in the debate felt like the most basic kind of betrayal I could imagine.

Yeah, I said felt. At least I didn't play the Colorform card.

Anyway, after watching Colin Quinn's comedy show I think I have a better understanding of the NYC personality. I have only been there twice since 1972 and I had forgotten much that I used to know about such types. So I am willing to wait until he takes office before giving up on that LSoS.

Anyway you twist and turn it, in 6-9 months time it will be trump and the republicans budget.
Unless he puts in some of the meat he promised the middle voters, bot parties will be DOA, remember 1982. Reagan learned a lot from his misfortunes back then and maybe Trump have to do the same.

There is between 60-70 seats in congress that will flip, if the deal isnt good enough for the working voter.

And they care most about work and salary and health care in that order.
If he does not deliver on those promises, he is toast, so spending time chasing Clinton is a distraction.

I dunno, maybe Obama's being rolled by Trump into not pardoning the Hildebeast, then activating the full force of the Justice Department against her after Jan 20. I know, wishful thinking.
