Supreme Court block transgender from using boys' restroom

Los Angeles TimesThe Supreme Court intervened for the first time Wednesday in the controversy over transgender rights and blocked a lower court ruling that would have allowed a transgender boy to use the high school restroom that fits his “gender identity.”

In an unusual 5-3 order, the justices granted an emergency appeal from a Virginia school board, which said it is fighting to “protect the basic expectations of bodily privacy of Gloucester County students.”

The school board was seeking to be exempted from the Obama administration’s position that schools nationwide are required to allow transgender students to use the bathroom they prefer.

Justice Stephen G. Breyer signaled he did not support the school board’s emergency appeal, but said he joined the court’s four conservatives as a “courtesy” to put the issue on hold until the justices can review the matter when they return in the fall.

“In light of the facts that four justices have voted to grant the application referred to the court by the chief justice, that we are currently on recess and that granting the stay will preserve the status quo,” he wrote, “I vote to grant the application as a courtesy.”

With the vote for review from Souter, I guess he is betting Merrick Garland will be joining him to create the majority. Still, Anthony Kennedy or John Roberts can always be depended on to flip if things look too close.

Not a good issue for the Democrats. The stay pushes it out of the news. The courtesy was to Hillary.

It sure did get a lot of attention for a small story. Without the stay the lower court decision would have allowed the administration's transgendered policy of open bathrooms to move forward and that would have highlighted the importance of future SC appointments - to Hillary's detriment.

You could be right though. This was a national story (the entire transgender issue, not just NC) and we'll have to see if it gets mainstream coverage between now and the election. I'm betting that it largely disappears outside of online conservative media.

They are not the supreme court, not by a long shot. They are clearly, very clearly, the lowest court in all the land dressed up to appear the most important. They are to a person mind-numbingly retarded in their area of expertise. Their area being shit. The shitiest most stupid cases of all end up there by rolling to the lowest most expensive point possible.

Goes like this: We've been banging our heads over this legal problem for years, all our heads are bloodied from banging, we cannot reach a solution by ourselves, that's how retarded this intractable problem. Even the Supremes are helping her. It reminds me of that scene with Obama and Dmitri - after the election I'll have more flexibility.

Do you think the left will leave Trump alone after he wins. I assure you articles of impeachment and every other RMPC lawyer tactic is going to be employed against him the day he is inaugurated. They will spend four years throwing everything at him and I suspect republicans will probably join in too.
